Is there any organization that will help represent me (free or little cost) in upcoming court case? Cont….?
Single mom Of 4 month old boy. Im taking the "donor" to court for paternity, child support/ custody, & medical… Only problem is I have no-one to represent me in court. The dad will not return any calls or e-mails & I have not spoken to him since Jan. Since Im staying under my moms roof, they combined her income (less then 20,000 a year) with my 401 K (approx. 10,000) & said " I " make to much for free legal representation. (3 adults & 1 infant) Her income is not mine! & to take my 401K out would mean me geeting penalized 30%… I’ve looked into NJ Bar, family planning groups, free legal advise sites, etc. – but I can’t seem to find REPRESENTATION (To stand up infront of the court & speak on my behalf) for an actual court date coming up the begging of Oct. you should call your court building and tell them your situation and ask them if they know where you can find a legal rep for you at no cost or low cost. they should be able to help you. i thought everyone had the right to legal representation, if you cant afford one, they will appoint one to you.

Try dail-a-lawyer (through the law society of Canada). They will give you one a lawyer’s number to call. usually you will get one hour free consultation. If you get a good one like i did, they will tell you what will happen on the first court date. Nothing much happens for awhile until he respond to your application, by returning the applicable information to the court that is requested of him (Disclosure). You do not need and should not contact the donor. Go to the Court house and pick up some free booklet information and make sure you read it thoroughly.
This is a lenthy process and you will need stamina and courage. It is not an easy process. Be prepared to miss some days from work. Go to a legal aid office you might find info there. Check out the Abuse center/immigrant center/ the YWCA/ UIC/check out the telephone directory for groups/organizations they should also have plenty of info of contacting legal representation. Empower yourself. go to the Law library at York University (cannot borrow book) U of T Go at University and Queenspark (cannot borrow books) Family law section. First you MUST prove "paternity". DNA is expensive and the "donor" has to give a sample. I personally, would seek child support first, you can do the paperwork yourself. What is this Court date in October… without that information,I can’t help you much, and you don’t have much time left. Depending on the Court, if you are the Plaintiff, the Crown will help you, if you are on the Defence – you can represent yourself, and maybe the Court will appoint a lawyer to you. A para-legal might be able to help you – but check it out first – paralegals want money up-front. See if you can find, thru the Law Society listings – a lawyer – who will give you a free consultation – and some of them will "waive" their fees – if they feel you will come into a "cash settlement". That can be expensive at the end, usually 30 – 33% of the settlement.I am never amazed at the number of children that are born before the prospective parents have thought things through… Good Luck and slow down. go to your local court house and try thefree legal clinic for families. they usually have it open once or twice a week. also look in your phone book under lawyers and they usually have legal advice lines and access to lawyers over the phone for no cost.
